1. Introduction and Acceptance
Welcome to Rentora ("Platform," "Service," "we," "us," or "our"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Rentora, Inc., governing your access to and use of our property management platform, including all associated services, features, and artificial intelligence capabilities.
By creating an account, accessing, or using Rentora, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
⚠️ IMPORTANT: This Platform utilizes artificial intelligence (AI) systems to assist with various property management decisions. Please read Section 6 (AI-Powered Features and Decision Making) carefully to understand how AI operates within our Platform and your responsibilities regarding AI-generated recommendations.
2. Eligibility and Account Registration
To use Rentora, you must:
- Be at least 18 years of age or the age of legal majority in your jurisdiction
- Have the legal authority to enter into binding contracts
- Not be prohibited from using the Service under applicable laws
- Provide accurate, current, and complete information during registration
- Maintain the security and confidentiality of your account credentials
You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach.
3. Service Description
Rentora provides a comprehensive property management platform that includes, but is not limited to:
- Property and unit management tools
- Tenant relationship management and communication systems
- Lease creation, management, and electronic signing
- Rent collection and financial tracking
- Maintenance request management and contractor coordination
- AI-powered document generation and analysis
- AI-assisted tenant screening recommendations
- AI-driven maintenance triage and prioritization
- Automated communication and response suggestions
- Compliance monitoring and alerts
4. User Responsibilities and Compliance
By using Rentora, you agree to:
- Comply with all applicable federal, state, and local laws, including fair housing laws
- Use the Platform only for lawful property management purposes
- Not discriminate against any person based on protected characteristics
- Provide accurate information about properties, tenants, and financial matters
- Maintain appropriate licenses and permits required for property management in your jurisdiction
- Not use the Platform to harass, abuse, or harm others
- Not attempt to circumvent security features or access unauthorized areas
5. Data Collection, Privacy, and Security
Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key data practices include:
- Collection of property, tenant, and financial data necessary for Platform operation
- Use of data to train and improve AI systems (with appropriate anonymization)
- Secure storage using industry-standard encryption
- Limited sharing with third parties as necessary for service provision
- Data retention in accordance with legal requirements
6. AI-Powered Features and Decision Making
6.1 Overview of AI Capabilities
Rentora integrates advanced artificial intelligence systems throughout the Platform to enhance property management efficiency. These AI systems analyze data, generate recommendations, automate routine tasks, and assist in decision-making processes. Our AI capabilities include:
- Maintenance Triage AI: Analyzes maintenance requests to assess urgency, estimate costs, recommend appropriate contractors, and suggest priority levels
- Tenant Screening AI: Evaluates rental applications based on provided criteria and generates risk assessments
- Document Generation AI: Creates lease agreements, notices, and other legal documents based on templates and user inputs
- Communication AI: Suggests responses to tenant inquiries and generates professional correspondence
- Leasing Agent AI: Responds to prospective tenant inquiries about listings
- Financial Analysis AI: Provides insights on rental pricing, expense patterns, and financial projections
- Compliance Monitoring AI: Monitors for potential regulatory issues and suggests corrective actions
6.2 Nature of AI Recommendations
🚨 CRITICAL UNDERSTANDING: All AI-generated content, recommendations, analyses, and suggestions are provided as ADVISORY TOOLS ONLY. They do not constitute legal, financial, or professional advice.
You expressly acknowledge and agree that:
- AI recommendations are generated by machine learning algorithms and may contain errors, inaccuracies, or biases
- AI systems make probabilistic predictions based on available data and may not account for all relevant factors
- AI cannot replace human judgment, particularly in matters requiring legal compliance, ethical considerations, or nuanced understanding
- You retain full responsibility for all decisions made using or based on AI recommendations
- AI-generated documents must be reviewed by qualified professionals before execution
6.3 Human Override and Final Decision Authority
YOU ARE REQUIRED TO EXERCISE INDEPENDENT JUDGMENT on all matters where AI provides recommendations. Specifically:
- Tenant Screening: You must independently verify all information and make screening decisions in compliance with fair housing laws. AI screening scores are suggestions only and must not be the sole basis for accepting or rejecting applicants.
- Maintenance Decisions: You are responsible for verifying AI cost estimates, urgency assessments, and contractor recommendations. Safety-critical issues require immediate human evaluation.
- Legal Documents: All AI-generated leases, notices, and legal documents must be reviewed by a qualified attorney familiar with your jurisdiction before use.
- Financial Decisions: AI financial projections and pricing recommendations should be verified against market data and professional financial advice.
- Communications: AI-suggested responses should be reviewed and modified as necessary before sending to ensure accuracy and appropriateness.
6.4 Fair Housing and Non-Discrimination
⚖️ Rentora is committed to fair housing compliance. Our AI systems are designed to avoid discrimination based on protected characteristics under federal, state, and local fair housing laws.
- AI tenant screening tools do not consider race, color, national origin, religion, sex, familial status, disability, or other protected characteristics
- You will not use AI tools to discriminate against any protected class
- You are solely responsible for ensuring your use of AI tools complies with all applicable fair housing laws
- Violation of fair housing laws using our Platform may result in immediate account termination
7. Third-Party Contractors and Services
Rentora facilitates connections with third-party contractors for maintenance and repair services. You acknowledge that:
- Contractors are independent service providers, not employees or agents of Rentora
- You are responsible for verifying contractor credentials, licenses, and insurance
- AI-recommended contractors are suggestions only; final selection is your responsibility
- Rentora is not liable for contractor work quality, delays, or damages
- Payment disputes with contractors are between you and the contractor
8. Fees, Payments, and Billing
Rentora offers various subscription tiers with different features and pricing. By subscribing, you agree to:
- Pay all applicable fees as described in your selected subscription plan
- Provide accurate and current payment information
- Authorize automatic recurring charges unless you cancel
- Pay any applicable taxes associated with your subscription
We reserve the right to change pricing with 30 days' notice. Continued use after price changes constitutes acceptance of new pricing.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- RENTORA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- RENTORA'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
- RENTORA IS NOT LIABLE FOR DAMAGES ARISING FROM AI RECOMMENDATIONS, SUGGESTIONS, OR GENERATED CONTENT
- RENTORA IS NOT LIABLE FOR DECISIONS MADE BASED ON AI ANALYSIS OR RECOMMENDATIONS
- RENTORA IS NOT LIABLE FOR THIRD-PARTY CONTRACTOR ACTIONS OR OMISSIONS
- RENTORA IS NOT LIABLE FOR LEGAL COMPLIANCE FAILURES RESULTING FROM USER ACTIONS
10. Indemnification
You agree to indemnify, defend, and hold harmless Rentora and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Platform
- Decisions made based on AI recommendations
- Violation of these Terms
- Violation of any applicable laws or regulations
- Violation of fair housing or anti-discrimination laws
- Disputes with tenants, contractors, or other third parties
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RECOMMENDATIONS WILL BE ACCURATE OR SUITABLE FOR YOUR NEEDS.
12. Termination
Either party may terminate this agreement at any time. Upon termination:
- Your access to the Platform will be suspended
- You may export your data within 30 days of termination
- Outstanding fees remain due and payable
- Provisions that by their nature should survive will remain in effect
We may terminate or suspend your account immediately for violations of these Terms or applicable law.
13. Dispute Resolution and Arbitration
Any disputes arising from these Terms or use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You agree to waive your right to a jury trial and to participate in class action lawsuits.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or Platform notification at least 30 days before changes take effect. Continued use after changes constitutes acceptance of modified Terms.
